法律語(yǔ)言是不同于一般語(yǔ)言的法律載體[1]，具有準(zhǔn)確和簡(jiǎn)潔的特點(diǎn)，要求用詞正式、嚴(yán)肅并確切。因此，普通英語(yǔ)詞匯在法律文本中的使用與日常英語(yǔ)有所不同，主要體現(xiàn)在搭配和譯法方面，成為學(xué)習(xí)難點(diǎn)。本文試圖探討otherwise在《聯(lián)合國(guó)移民、難民公約英漢平行語(yǔ)料庫(kù)》中的用法和譯法。

一、《聯(lián)合國(guó)移民、難民公約英漢平行語(yǔ)料庫(kù)》內(nèi)容簡(jiǎn)介

《聯(lián)合國(guó)移民、難民公約英漢平行語(yǔ)料庫(kù)》為雙語(yǔ)平行語(yǔ)料庫(kù)，主要由聯(lián)合國(guó)簽署的有關(guān)移民、難民的法律公約和議定書，中英美等各國(guó)移民和難民法規(guī)以及國(guó)際移民組織有關(guān)文獻(xiàn)等組成。語(yǔ)料庫(kù)容約為800萬(wàn)字符，117部法律文件。該語(yǔ)料庫(kù)的建成不僅可以豐富國(guó)內(nèi)法律語(yǔ)料庫(kù)的建設(shè)，還能為學(xué)員畢業(yè)論文的撰寫和相關(guān)專業(yè)研究提供一定幫助。

語(yǔ)料庫(kù)的研究方法有利于從大量的語(yǔ)料剖析語(yǔ)言的特點(diǎn)[2]。近年來(lái)，語(yǔ)料庫(kù)已經(jīng)成為翻譯研究的一個(gè)重要手段[3]。本文基于自建的移民、難民法律公約語(yǔ)料庫(kù)，運(yùn)用AntConc軟件，檢索出在本語(yǔ)料庫(kù)中所有的otherwise，采用定量分析的方法，探討otherwise在本語(yǔ)料庫(kù)中的用法和譯法。

二、otherwise的用法和譯法分析

根據(jù)《牛津高階英漢雙解詞典：第6版》的解釋，otherwise是副詞，主要有三個(gè)意思：1.used to state what the result would be if sth. did not happen or if the situation were different(否則；不然)； 2.apart from that(除此以外)；3.in a different way to the way mentioned; differently(在其他方面；另；亦)[4]。otherwise在本語(yǔ)料庫(kù)中的用法和譯法討論如下。

(一)譯為“除……另有……外”

1.otherwise和unless連用

在本語(yǔ)料庫(kù)中，通過(guò)使用AntConc軟件統(tǒng)計(jì)，發(fā)現(xiàn)otherwise總共使用了37次。其中unless和otherwise連用的情況最多，共有8次，后面主要接provided，decided，requested和agreed，其中provided使用最多，共有5次。在這里otherwise的意思和上述牛津詞典解釋中的第三個(gè)意思相同，為“in a different way to the way mentioned; differently”(在其他方面；另；亦)。使用的句式為unless+(it is)+otherwise+動(dòng)詞過(guò)去分詞，省略了it is，一般翻譯為“除非另有規(guī)定外，除……另有……外”。例如“The provisions of the Convention shall apply, mutatis mutandis, to this Protocol unless otherwise provided herein.”譯為“除非本議定書中另有規(guī)定，公約的規(guī)定應(yīng)經(jīng)適當(dāng)變通后適用于本議定書?！?出自“Protocol against the Illicit Manufacturing of and Trafficking in Firearms, Their Parts and Components and Ammunition, supplementing the United Nations Convention against Transnational Organized Crime”《聯(lián)合國(guó)打擊跨國(guó)有組織犯罪公約關(guān)于打擊非法制造和販運(yùn)槍支及其零部件和彈藥的補(bǔ)充議定書》)

除了unless和otherwise連用后加動(dòng)詞過(guò)去分詞的用法，還出現(xiàn)了unless...+otherwise直接和動(dòng)詞連用的情況，動(dòng)詞放置在otherwise前面或后面，共出現(xiàn)4次。其中兩次分別在“Worst Forms of Child Labour Convention”(《禁止和立即行動(dòng)消除最惡劣形式的童工勞動(dòng)公約》)和“Seafarers’ Identity Documents Convention (Revised), 2003 (No. 185)”(《2003年海員身份證件公約》)中，都是以“unless the new Convention otherwise provides”的形式出現(xiàn)，譯為“除新公約另有規(guī)定外”。另外一次在“Convention relating to the Status of Stateless Persons”(《關(guān)于無(wú)國(guó)籍人地位的公約》)中，原文“...unless compelling reasons of national security or public order otherwise require...”，譯為“除因國(guó)家安全或公共秩序的重大原因應(yīng)另作考慮外”。還有一次在“International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families”(《保護(hù)所有移徙工人及其家庭成員權(quán)利國(guó)際公約》)中，“...unless compelling reasons of national security require otherwise...”，譯為“除因國(guó)家安全的重大理由另有規(guī)定外”。

2.otherwise和except連用

根據(jù)統(tǒng)計(jì)結(jié)果，除unless之外和otherwise搭配使用比較多的是except as，共6次。except as otherwise后面接provided或stated，其中stated使用最多，共有4次。在這里otherwise的意思和上述牛津詞典解釋中的第三個(gè)意思相同，為“in a different way to the way mentioned; differently”(在其他方面；另；亦)。這里使用的句式為except+ as +(it is)+otherwise+動(dòng)詞過(guò)去分詞，省略了it is，與unless...+otherwise相似，翻譯為“除……另有規(guī)定外”。例如“The present Convention is applicable, except as otherwise provided hereafter, to all migrant workers and members of their families without distinction of any kind such as sex, race, colour, language, religion or conviction, political or other opinion, national, ethnic or social origin, nationality, age, economic position, property, marital status, birth or other status.”譯為“本公約，除此后另有規(guī)定外，適用于所有移徙工人及其家庭成員，不分性別、種族、膚色、語(yǔ)言、宗教或信念、政治見(jiàn)解或其他意見(jiàn)、民族、族商或社會(huì)根源、國(guó)籍、年齡、經(jīng)濟(jì)地位、財(cái)產(chǎn)、婚姻狀況、出身或其他身分地位等任何區(qū)別。”(出自“International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families”《保護(hù)所有移徙工人及其家庭成員權(quán)利國(guó)際公約》)

還有一處except和otherwise的搭配，在“Convention relating to the Status of Stateless Persons”(《關(guān)于無(wú)國(guó)籍人地位的公約》)中，原文為“...except where compelling reasons of national security otherwise require...”，譯為“除因國(guó)家安全的重大理由要求另作考慮外”，這個(gè)用法和上述的unless...+otherwise直接和動(dòng)詞連用的用法相似，也翻譯為“除……另有……外”。

(二)譯為“否則，不然”

通過(guò)統(tǒng)計(jì)發(fā)現(xiàn)would和otherwise搭配使用的情況也較多，共出現(xiàn)了6次，其中otherwise有5次用在would后面，1次用在would前面。這里otherwise都是做副詞，和上述牛津詞典解釋中的第一個(gè)意思相同，表示“否則，不然”。例如“States Parties shall ensure the implementation of these rights in accordance with their national law and their obligations under the relevant international instruments in this field, in particular where the child would otherwise be stateless.”譯為“締約國(guó)應(yīng)確保這些權(quán)利按照本國(guó)法律及其根據(jù)有關(guān)國(guó)際文書在這一領(lǐng)域所做承諾予以實(shí)施，尤應(yīng)注意不如此兒童即無(wú)國(guó)籍?！?出自“Convention on the Rights of the Child”《兒童權(quán)利公約》)

(三)譯為“或……”，“……或其他……”

本語(yǔ)料庫(kù)中，還出現(xiàn)了or otherwise+動(dòng)詞(包括動(dòng)詞分詞)的結(jié)構(gòu)，共出現(xiàn)4次，在“The Exit and Entry Administration Law of the People’s Republic of China”(《中華人民共和國(guó)出境入境管理法》)中出現(xiàn)2次，在“United Nations Convention against Transnational Organized Crime”(《聯(lián)合國(guó)打擊跨國(guó)有組織犯罪公約及其議定書》)也出現(xiàn)2次，都理解或翻譯為“或……”“或……其他……”。例如“Where foreigners engage in activities not corresponding to the purposes of stay or residence, or otherwise violate the laws or regulations of China, which makes them no longer eligible to stay or reside in China, they may be ordered to exit China within a time limit.”譯為“外國(guó)人從事與停留居留事由不相符的活動(dòng)，或者有其他違反中國(guó)法律、法規(guī)規(guī)定，不適宜在中國(guó)境內(nèi)繼續(xù)停留居留情形的，可以處限期出境?！?出自“The Exit and Entry Administration Law of the People’s Republic of China”《中華人民共和國(guó)出境入境管理法》)

這里or otherwise的用法和普通用法不同，《牛津高階英漢雙解詞典：第6版》中or otherwise的解釋是“used to refer to sth. that is different from or the opposite of what has just been mentioned”(或其他情況；或相反)。而在本語(yǔ)料庫(kù)中or otherwise表示“以其他方式”，因此翻譯時(shí)要根據(jù)上下文選擇合適的譯法[5]。

(四)譯為“不同，不同于”

還有otherwise和than搭配使用，只出現(xiàn)了一次，在“International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families”(《保護(hù)所有移徙工人及其家庭成員權(quán)利國(guó)際公約》)中，第2條第2點(diǎn)h點(diǎn)“The term “self-employed worker” refers to a migrant worker who is engaged in a remunerated activity otherwise than under a contract of employment and who earns his or her living through this activity normally working alone or together with members of his or her family, and to any other migrant worker recognized as self-employed by applicable legislation of the State of employment or bilateral or multilateral agreements.”譯為“‘自營(yíng)職業(yè)工人’一詞是指從事非屬雇用合同的有報(bào)酬活動(dòng)，通常是單獨(dú)或與其家庭成員共同通過(guò)此種活動(dòng)謀生的移徙工人，以及經(jīng)就業(yè)國(guó)適用的立法或雙邊或多邊協(xié)定承認(rèn)為從事自營(yíng)職業(yè)的任何其他移徙工人”。這里otherwise than的意思和other than相似，譯為“不同，不同于”。

(五)譯為“另外”或“以其他方式”

除了上述幾種出現(xiàn)頻率比較多的otherwise的用法，otherwise在本語(yǔ)料庫(kù)中的其他用法基本上都是翻譯為“另外”，或“以其他方式”。

例如在“Convention on the Reduction of Statelessness”(《減少無(wú)國(guó)籍狀態(tài)公約》)中，第10條第2點(diǎn)“In the absence of such provisions a Contracting State to which territory is transferred or which otherwise acquires territory shall confer its nationality on such persons as would otherwise become stateless as a result of the transfer or acquisition.”譯為“如無(wú)此種條款時(shí)，接受移轉(zhuǎn)領(lǐng)土或以其他方式取得領(lǐng)土之締約國(guó)，對(duì)因領(lǐng)土之移轉(zhuǎn)或取得而致非經(jīng)授與國(guó)籍即無(wú)國(guó)籍者，應(yīng)授與該國(guó)國(guó)籍?！?/p>

這里有兩個(gè)otherwise，第一個(gè)譯為“以其他方式”，第二個(gè)是和would搭配，譯為“否則，不然”。

又如在“International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families”(《保護(hù)所有移徙工人及其家庭成員權(quán)利國(guó)際公約》)中，第22條第3點(diǎn)“The decision shall be communicated to them in a language they understand, upon their request where not otherwise mandatory, the decision shall be communicated to them in writing and, save in exceptional circumstances on account of national security, the reasons for the decision likewise stated.”譯為“應(yīng)以他們所了解的語(yǔ)言將判決傳達(dá)給他們，如果沒(méi)有另外的強(qiáng)制性規(guī)定，經(jīng)他們要求，應(yīng)以書面方式將判決傳達(dá)給他們，除涉及國(guó)家安全的特殊情況外，應(yīng)說(shuō)明判決的理由?！边@里的otherwise譯為“另外”。

同樣在“Seafarers’ Identity Documents Convention (Revised), 2003 (No. 185)”(《2003年海員身份證件公約》)中，3.12.3項(xiàng)“...verification, with the passport authority or other competent authority, of the genuineness of the passport or other document produced; where there is reason to doubt the genuineness of the passport, the original should be sent to the authority concerned; otherwise, a copy of the relevant pages may be sent.”譯為“向護(hù)照頒發(fā)機(jī)關(guān)或其他主管機(jī)關(guān)核查護(hù)照或所出示的其他證件的真實(shí)性；如有理由懷疑護(hù)照的真實(shí)性，應(yīng)將原件寄給有關(guān)機(jī)關(guān)；另外，也可寄出有關(guān)頁(yè)的復(fù)印件。”這里的otherwise譯為“另外”。

三、結(jié)束語(yǔ)

綜上所述，在本語(yǔ)料庫(kù)中，和otherwise搭配比較多的詞有unless和except，翻譯為“除……另有……外”；除了otherwise和would搭配時(shí)翻譯為“否則，不然”，or otherwise譯為“或……”，“或……其他……”，otherwise than的意思和other than相似，譯為“不同，不同于”，其他基本上都是翻譯為“另外”，或“以其他方式”。這和otherwise在《牛津高階英漢雙解詞典：第6版》中的第三種解釋是相符的，表示“in a different way to the way mentioned; differently”(在其他方面；另；亦)。因此，otherwise除了和unless等幾個(gè)詞搭配時(shí)的譯法是基本固定的，其他譯法和otherwise的普通用法和譯法沒(méi)有區(qū)別，與詞典第三種釋義相同。otherwise的用法和譯法值得英語(yǔ)研究者和學(xué)習(xí)者注意，有助于更好地理解英文法律文本中的邏輯關(guān)系。注重更多的常用英文法律詞匯的譯法，也有利于英文法律語(yǔ)言的翻譯和學(xué)習(xí)。
