In Rawls’theory of justice，Rawls has always taken utilitarianism as major rivalry and target of criticism in order to justify justice as fairness.Creatively，Rawls categorized utilitarianism into three forms：classic utilitarianism，average utilitarianism and restricted utilitarianism. Comparison between these forms of utilitarianism and two principles of justice can show advantages of justice as fairness，thus criticize utilitarianism comprehensively. The theoretical power of Rawls’criticism towards these three forms of utilitarianism is diminishing，especially，limited utilitarianism constitutes an unignorable challenge to justice as fairness.Utilitarianism will not simply fade away，but enter the arena in new forms.In order to replace utilitarianism thoroughly，Rawls must provide more sufficient reasons.

It is urgent to update and adjust the criminal situation and typical characteristics in the network era，and construct a coordinated criminal policy that dynamically adapts to it.The upgrading of social structure in the Internet era is driven by technology.Technology and its risks run through the whole process of social governance.Collaborative criminal policy should follow the concept of relativism crime，with the goal of regulating risk，controlling crime rather than eliminating risk，and eradicating crime. From the perspective of social psychology，cultural confidence is divided into cultural identity in psychological dimension and confidence in cultural development in temporal dimension.In the view of needs satisfaction，cultural needs satisfaction at individual and social level can affect the formation of cultural confidence. The assumption was verified through a sample survey of 35668 residents in 31 provinces in China.The results show that the level of cultural confidence of Chinese residents is relatively high，but there are differences among different groups and regions.Residents’cultural needs can be basically satisfied，and the higher the degree of satisfaction，the higher the level of cultural confidence. The way to enhance cultural confidence is，on the one hand，to focus on the human-oriented，and promote cultural development on the basis of understanding the cultural needs of different groups.On the other hand，it is to make the cultural inheritance and innovation and the international influence of culture visible to promote the formation of social consensus on Chinese culture.
