摘 要:在當(dāng)前的經(jīng)濟(jì)新常態(tài)下,經(jīng)濟(jì)轉(zhuǎn)型與經(jīng)濟(jì)創(chuàng)新是我國(guó)經(jīng)濟(jì)發(fā)展的核心問(wèn)題。經(jīng)濟(jì)轉(zhuǎn)型與經(jīng)濟(jì)創(chuàng)新對(duì)經(jīng)濟(jì)法理論與實(shí)踐提出了更高的新要求。面對(duì)經(jīng)濟(jì)轉(zhuǎn)型和經(jīng)濟(jì)創(chuàng)新中新情況與新問(wèn)題的挑戰(zhàn),經(jīng)濟(jì)法必須在理論與實(shí)踐層面進(jìn)行有效回應(yīng)。經(jīng)濟(jì)法具有“剛”與“柔”兩個(gè)屬性,通過(guò)對(duì)經(jīng)濟(jì)法相關(guān)理論的分析和現(xiàn)實(shí)生活中具體實(shí)例的驗(yàn)證可以發(fā)現(xiàn),經(jīng)濟(jì)法的“剛?cè)岵?jì)”的差異性適用理論能夠較好地回應(yīng)經(jīng)濟(jì)轉(zhuǎn)型與經(jīng)濟(jì)創(chuàng)新中所出現(xiàn)的各種問(wèn)題。構(gòu)建經(jīng)濟(jì)法的“剛?cè)岵?jì)”的差異性適用長(zhǎng)效機(jī)制需要從理論體系、立法層面、執(zhí)法層面和司法層面等方面著手。

1 對(duì)我國(guó)經(jīng)濟(jì)轉(zhuǎn)型問(wèn)題的理解
隨著我國(guó)經(jīng)濟(jì)形式的不斷變化,我國(guó)更加重視經(jīng)濟(jì)的轉(zhuǎn)型,經(jīng)濟(jì)轉(zhuǎn)型不僅是我們國(guó)家重視的問(wèn)題,也是各個(gè)國(guó)家都普遍重視的內(nèi)容。經(jīng)濟(jì)轉(zhuǎn)型過(guò)程一般是由農(nóng)村經(jīng)濟(jì)向城市轉(zhuǎn)移,也是每個(gè)國(guó)家都普遍重視的問(wèn)題,傳統(tǒng)的經(jīng)濟(jì)轉(zhuǎn)型模式比較單一,在傳統(tǒng)的經(jīng)濟(jì)學(xué)理論中,一般是指農(nóng)業(yè)向工業(yè)的轉(zhuǎn)型以及農(nóng)業(yè)社會(huì)向工業(yè)社會(huì)的轉(zhuǎn)型。這一轉(zhuǎn)型對(duì)于一個(gè)國(guó)家的經(jīng)濟(jì)現(xiàn)代化具有十分重要的意義。我國(guó)的經(jīng)濟(jì)轉(zhuǎn)型還包括從計(jì)劃經(jīng)濟(jì)體制向市場(chǎng)經(jīng)濟(jì)體制的轉(zhuǎn)型,是一種雙重的“經(jīng)濟(jì)轉(zhuǎn)型”。經(jīng)濟(jì)轉(zhuǎn)型過(guò)程中,還存在很多問(wèn)題,比如,經(jīng)濟(jì)模式比較單一經(jīng)濟(jì)管理方式不適用以及經(jīng)濟(jì)體制的不成熟,導(dǎo)致經(jīng)濟(jì)轉(zhuǎn)型障礙重重,經(jīng)濟(jì)轉(zhuǎn)型要通過(guò)改變思想,掌握經(jīng)濟(jì)變化規(guī)律來(lái)實(shí)現(xiàn)。從目前我國(guó)的發(fā)展形勢(shì)來(lái)看,我國(guó)的經(jīng)濟(jì)面臨巨大的阻力就是投資問(wèn)題,特別是城市的發(fā)展,調(diào)整經(jīng)濟(jì)結(jié)構(gòu)對(duì)于實(shí)現(xiàn)經(jīng)濟(jì)轉(zhuǎn)型有重要作用。需要注意以下幾點(diǎn)內(nèi)容,第一,要熟悉我國(guó)的經(jīng)濟(jì)發(fā)展形勢(shì),調(diào)整經(jīng)濟(jì)結(jié)構(gòu)。第二,要選擇經(jīng)濟(jì)轉(zhuǎn)型的方式,結(jié)合自身國(guó)家的發(fā)展特征選擇合適的經(jīng)濟(jì)轉(zhuǎn)型方式。第三,要選擇合適的經(jīng)濟(jì)轉(zhuǎn)型戰(zhàn)略,根據(jù)經(jīng)濟(jì)需求選擇合適的轉(zhuǎn)型方式。以調(diào)整轉(zhuǎn)型對(duì)象之間的矛盾為主。
2 對(duì)經(jīng)濟(jì)創(chuàng)新的探究
經(jīng)濟(jì)創(chuàng)新是我國(guó)經(jīng)濟(jì)轉(zhuǎn)型過(guò)程中出現(xiàn)的問(wèn)題,經(jīng)濟(jì)創(chuàng)新能夠提高經(jīng)濟(jì)轉(zhuǎn)型的速度,從一定程度上促進(jìn)了經(jīng)濟(jì)的轉(zhuǎn)型。也是我國(guó)新經(jīng)濟(jì)法實(shí)行的依據(jù)。經(jīng)濟(jì)創(chuàng)新指的是在原有經(jīng)濟(jì)基礎(chǔ)上,對(duì)經(jīng)濟(jì)發(fā)展形勢(shì)進(jìn)行規(guī)劃,創(chuàng)新經(jīng)濟(jì)發(fā)展模式,引進(jìn)新的經(jīng)濟(jì)發(fā)展理念,與經(jīng)濟(jì)格局,提高經(jīng)濟(jì)發(fā)展速度,促進(jìn)經(jīng)濟(jì)發(fā)展的改革。
3 經(jīng)濟(jì)轉(zhuǎn)型、經(jīng)濟(jì)創(chuàng)新與經(jīng)濟(jì)法的“剛?cè)岵?jì)”探究
首先,要建立相關(guān)的經(jīng)濟(jì)體系,要不斷總結(jié)經(jīng)濟(jì)發(fā)展的經(jīng)驗(yàn),選擇適合我們國(guó)家發(fā)展的經(jīng)濟(jì)體系,另外,要實(shí)現(xiàn)經(jīng)濟(jì)轉(zhuǎn)型、經(jīng)濟(jì)創(chuàng)新與經(jīng)濟(jì)法的“剛?cè)岵?jì)”,就必須從實(shí)際出發(fā),立足于我們國(guó)家的國(guó)情,不斷總結(jié)經(jīng)濟(jì)發(fā)展的經(jīng)驗(yàn),以積極的態(tài)度接受經(jīng)濟(jì)轉(zhuǎn)型帶來(lái)的影響,并利用經(jīng)濟(jì)轉(zhuǎn)型與經(jīng)濟(jì)創(chuàng)新的成果,探索新的經(jīng)濟(jì)發(fā)展形式。其次,要有理論依據(jù),經(jīng)濟(jì)發(fā)展要以國(guó)家相關(guān)的法律為基礎(chǔ),還要重視經(jīng)濟(jì)轉(zhuǎn)型與經(jīng)濟(jì)創(chuàng)新中存在的問(wèn)題,逐步解決這些問(wèn)題,提高經(jīng)濟(jì)水平。最后,要對(duì)經(jīng)濟(jì)法進(jìn)行總結(jié),根據(jù)我們國(guó)家經(jīng)濟(jì)發(fā)展形式,規(guī)劃經(jīng)濟(jì)發(fā)展的新格局,將經(jīng)濟(jì)哲學(xué)和法哲學(xué)結(jié)合在一起,為經(jīng)濟(jì)法提供理論依據(jù),構(gòu)建新的理論體系,實(shí)現(xiàn)經(jīng)濟(jì)的高效發(fā)展。
其次,要構(gòu)建經(jīng)濟(jì)法立法層面的“剛?cè)岵?jì)”機(jī)制。經(jīng)濟(jì)轉(zhuǎn)型和經(jīng)濟(jì)創(chuàng)新往往面臨很多挑戰(zhàn),面對(duì)這些挑戰(zhàn),我們必須調(diào)整經(jīng)濟(jì)法,經(jīng)濟(jì)法要適合國(guó)家的發(fā)展情況,不能過(guò)于“剛”,在保證一定約束力的同時(shí),還要有創(chuàng)新,在立法過(guò)程中,要根據(jù)各地區(qū)的經(jīng)濟(jì)水平,選擇不同的經(jīng)濟(jì)管理法,做到公平,能夠正確對(duì)待經(jīng)濟(jì)發(fā)展中存在的問(wèn)題,為實(shí)現(xiàn)經(jīng)濟(jì)法執(zhí)法與經(jīng)濟(jì)法司法層面的“剛?cè)岵?jì)”提供立法方面的基礎(chǔ)。最后,要引進(jìn)先進(jìn)的經(jīng)濟(jì)發(fā)展理念,通過(guò)分析國(guó)外有效的經(jīng)濟(jì)建設(shè)活動(dòng),結(jié)合我們國(guó)家的經(jīng)濟(jì)發(fā)展規(guī)律,規(guī)劃新的經(jīng)濟(jì)發(fā)展法則。
第三,要構(gòu)建經(jīng)濟(jì)法執(zhí)法層面的“剛?cè)岵?jì)”機(jī)制。法律是保障經(jīng)濟(jì)法執(zhí)行的最佳依據(jù),法律具有強(qiáng)制性,在經(jīng)濟(jì)法的基礎(chǔ)上,通過(guò)法律支持能夠提高經(jīng)濟(jì)法的執(zhí)行力,同時(shí),還能體現(xiàn)經(jīng)濟(jì)法“剛”的原則,在執(zhí)法層面上,通過(guò)落實(shí)法律制度,能夠提高企業(yè)對(duì)經(jīng)濟(jì)法的重視,“剛?cè)岵?jì)”體現(xiàn)在制度與執(zhí)行力的協(xié)調(diào),通過(guò)加強(qiáng)執(zhí)行力,保障經(jīng)濟(jì)制度得以落實(shí),對(duì)于經(jīng)濟(jì)發(fā)展有重要意義。經(jīng)濟(jì)法的“剛?cè)岵?jì)”從其基本含義上來(lái)看就是對(duì)經(jīng)濟(jì)法的執(zhí)法所提出的基本要求,是從規(guī)范政府與市場(chǎng)之間的關(guān)系的角度來(lái)強(qiáng)調(diào)經(jīng)濟(jì)法在執(zhí)法的過(guò)程中能夠充分把握“剛”與“柔”的平衡,以有效應(yīng)對(duì)現(xiàn)實(shí)生活中的經(jīng)濟(jì)法問(wèn)題。在這個(gè)過(guò)程中,要體現(xiàn)經(jīng)濟(jì)法的作用。
最后,要構(gòu)建經(jīng)濟(jì)法司法層面的“剛?cè)岵?jì)”機(jī)制。司法具有公平性,經(jīng)濟(jì)法在執(zhí)行過(guò)程中,往往會(huì)出現(xiàn)經(jīng)濟(jì)執(zhí)行力度不夠的問(wèn)題,不能完整的落實(shí)經(jīng)濟(jì)法,還會(huì)對(duì)整個(gè)經(jīng)濟(jì)發(fā)展體系的構(gòu)建造成影響,所以,要通過(guò)司法手段,提高經(jīng)濟(jì)法的落實(shí)力度。能夠從根本上減少經(jīng)濟(jì)發(fā)展中的一些問(wèn)題,制定有效的經(jīng)濟(jì)格局,提高經(jīng)濟(jì)發(fā)展效率。

經(jīng)濟(jì)轉(zhuǎn)型、經(jīng)濟(jì)創(chuàng)新與經(jīng)濟(jì)法的“剛?cè)岵?jì)”是經(jīng)濟(jì)發(fā)展的必經(jīng)之路。對(duì)于經(jīng)濟(jì)發(fā)展有重要作用。經(jīng)濟(jì)轉(zhuǎn)型體現(xiàn)了經(jīng)濟(jì)形式的轉(zhuǎn)變,通過(guò)轉(zhuǎn)型,能夠提高經(jīng)濟(jì)的使用率,還能提高經(jīng)濟(jì)的發(fā)展水平。經(jīng)濟(jì)創(chuàng)新能夠體現(xiàn)經(jīng)濟(jì)體制的改革,能夠探索適合我們國(guó)家發(fā)展的道路,提高經(jīng)濟(jì)發(fā)展效率。而經(jīng)濟(jì)法又是對(duì)兩種經(jīng)濟(jì)發(fā)展方式的總結(jié),能夠提高經(jīng)濟(jì)發(fā)展效率,從本上約束經(jīng)濟(jì)行為。實(shí)現(xiàn)經(jīng)濟(jì)轉(zhuǎn)型、經(jīng)濟(jì)創(chuàng)新與經(jīng)濟(jì)法的“剛?cè)岵?jì)”對(duì)于我國(guó)經(jīng)濟(jì)的發(fā)展有重要意義。
